CC&Rs

One of the key legal documents governing the community is the Declaration of Covenants, Conditions and Restrictions (CC&Rs). The CC&Rs formally document the rules of the community and provide for the legal enforcement of those rules. The CC&Rs form the basis of what is typically known as a “Deed-Restricted Community.” The purpose of CC&Rs generally “…is to preserve so far as possible the natural beauty of the Property; to avoid harsh contrasts between structures and landscape; to guard against the erection of poorly designed or proportioned structures and use of unsuitable materials; to encourage and secure the erection of attractive improvements which are harmonious with their sites; and in general to enhance the environmental quality and economic value of the Property.”

Every owner is provided a copy of the CC&Rs upon closing on the property. Renters/lessees are to be provided a copy by the property owner or office staff. Copies may be obtained from for a nominal charge for reproduction. The original is on file at the Bexar County Court House for public review.

The CC&Rs apply to ALL Westcreek residents, whether owner or renter/lessee. The CC&Rs attach to the property itself, and not to ownership of the property. The property must conform to the CC&Rs regardless of who physically occupies the property. However, the owner does retain ultimate responsibility for ensuring conformance. Typically, though, a renter/lessee will be the one directly contacted to correct minor discrepancies (such as lawn maintenance).

BYLAWS

The Bylaws of the Association specify the procedure for nomination and election of Directors, as well as the terms to be served by the respective Board members. Voting procedures and annual meeting procedures are also defined in this document.
